Reading & Research List April 2024

It's the first week of April 2024 and the Easter Holiday season ended at the start of the month. I had a four days in a row break from work over Easter, and probably could have done more during it. Nevertheless, spending time with family and over-indulging in food and drink together was enjoyable enough, and I even managed to fit in some interesting conversations when hanging out with family and friends over Easter.

One conversation with a friend of the family who's a retired Civil Engineer was particularly interesting to me. We talked on several different subjects but the recent Baltimore Boat & Ship Insurance Catastrophe was where I learned the most from him sharing many decades' worth of industry knowledge, and firsthand experience. I too had a lot to say because of my industry knowledge, and firsthand experience of Insurance Claims Management.

I'll start on this story.

Baltimore Ship & Bridge Insurance Catastrophe

The Baltimore Ship & Bridge Insurance Catastrophe happened early Tuesday morning March 26th, 2024, when a container ship "crashed" into the central section of Baltimore's Francis Scott Key Bridge. The impact from this collision caused the bridge to collapse, and insurance experts made early forecasts of collapse costs running into the billions (USD).⁽¹⁾ One day later, the insurance industry estimated insured losses to be above $1.5 billion and up to $4 billion of potential industry losses.⁽²⁾

Latest news from AM Best published yesterday indicates that Grace Ocean Pte Ltd., owner of the Singapore-flagged container ship “Dali," and Synergy Marine Pte Ltd., vessel manager, filed a petition for exoneration from or limitation of liability in U.S. District Court in Maryland ⁽³⁾.

The language employed in the AM Best article reads as if it was intended to confuse the reader, with oxymoronic statements such as;

The petition claims the event "was not due to any fault, neglect or want of care on the part of petitioners, the vessel, or any persons or entities for whose acts petitioners may be responsible."

To claim the event wasn't the fault of any parties (petitioners) who own the vessel or are (may be...?) responsible for the management of it implies causation of the event and how it became an insurance catastrophe are not related factors... Stupid and nonsensical to claim as such.. Reading further, we witness blatant cognitive dissonance in phrases such as;

While an investigation of the damage to the vessel is ongoing..

..petitioners claim they are "aware of potential demands or claims against them and/or the vessel arising out of the casualty..
..petitioners said they claim exoneration from liability for any and all losses or damage from the event..

It will take time to determine insured losses for the container ship that hit a bridge in Baltimore, as a number of investigations will be involved..

While determination of the cause will have to await an investigation.. ..it appears there may have been a loss of power and propulsion on the container ship before it hit the bridge as it appeared lights were going on and off in the last few moments,..
